1. Agreement Overview

By checking “I Agree,” booking a session, purchasing a membership, or using any SIM1Racing equipment or facilities, you (“Participant”) agree to all terms below. This agreement is between you and SIM1Racing LLC (“SIM1Racing,” “we,” “us,” or “our”).

This agreement covers simulator use, leagues, tournaments, private events, and all activities conducted at SIM1Racing’s Paramus, NJ location.

2. Assumption of Risk

You understand that racing simulators, like real driving, involve physical activity, sudden motion, and potential strain or discomfort. By participating, you voluntarily assume all risks of injury, whether caused by yourself, another participant, or equipment malfunction.

You agree that SIM1Racing is not responsible for any injury, loss, or damage to you, your property, or anyone accompanying you, except where prohibited by law.

3. Liability Release

To the fullest extent permitted by law, you release and hold harmless SIM1Racing LLC, its owners, employees, contractors, and affiliates from any and all claims, demands, damages, or causes of action arising out of participation or presence at our facility, including those caused by negligence.

If you damage equipment due to reckless or improper use, you agree to be financially responsible for repairs or replacement.

4. Safety and Conduct Rules

You agree to:

Follow all posted rules and staff instructions.
Use simulators responsibly and safely at all times.
Refrain from operating simulators if you are visibly impaired or intoxicated.
Not engage in rough behavior, horseplay, or tampering with equipment.
Respect other guests and SIM1Racing property.
Notify staff immediately of any equipment issues.

Food and Beverages:

Outside food and beverages are permitted in designated lounge areas.
Alcohol may be consumed responsibly by guests 21 years or older.
SIM1Racing reserves the right to refuse or end simulator access to anyone appearing impaired or unsafe to operate equipment.
Any spills, stains, or damage caused by food or drinks may result in a cleaning or repair fee.

Violation of these rules may result in immediate removal without refund.

5. Refunds and Payments

All payments, including memberships and session fees, are non-refundable once service has begun or a booking time has passed. Refunds or credits are issued solely at SIM1Racing’s discretion.

Chargebacks or disputed payments may result in suspension of membership or access privileges.

6. Minors (Under 18)

Participants under 18 must have a parent or legal guardian accept these terms on their behalf. The guardian assumes full responsibility for the minor’s participation and conduct while on premises.

7. Memberships

Members agree that this waiver and terms apply to all visits, events, and league activities during the membership period. Members do not need to re-sign for each visit unless the terms are updated.

SIM1Racing may modify membership terms or pricing with reasonable notice.

8. Photo & Media Release

By entering SIM1Racing, you consent to the use of photos or videos taken on-site for marketing, social media, or promotional purposes. If you do not wish to be photographed, please notify staff before your session.

9. Property and Personal Belongings

SIM1Racing is not responsible for lost, stolen, or damaged personal items. Please keep valuables secure at all times.

10. Alcohol and Substance Disclaimer

SIM1Racing does not sell or serve alcohol. Guests who bring and consume their own alcoholic beverages do so at their own risk. You understand that operating simulators while under the influence of alcohol or any substance increases the risk of injury or equipment damage.

By agreeing to these terms, you release SIM1Racing LLC from all liability related to alcohol consumption or intoxication while on premises, including any injury, damage, or claims resulting from impaired judgment or coordination.

11. Agreement to Terms

By checking the box below or continuing to use our simulators, you acknowledge that:

You have read and understood this agreement in full.
You voluntarily agree to its terms.
You are at least 18 years old, or a parent/guardian has agreed on your behalf.
